Pro surfer Jamie O'Brien loves sea turtles, but apparently not enough to respect their space.

O'Brien has a strong concerns over fibropapillomatosis, a herpes-type virus that affects these sea reptiles. He recently appeared in a professional photograph, seemingly "riding" one of the turtles. According to the San Francisco Chronicle, the controversy began brewing earlier this week, after some backlash about harassing the turtle.

But worse yet, O'Brien may have violated state and federal laws against harassing sea turtles. According to GrindTV, the act could be grounds for thousands of dollars in fines, though the blog seems to feel many are overreacting to the incident.

However, those who are upset by the photo, have more than one reason for their anger. According to the Chronicle, many native Hawaiians consider the honu -- the Hawaiian name of the turtle -- to be a sort of ancestral spirit. You can see one particularly popular video bashing O'Brien's actions below.

O'Brien has done little to respond to the controversy, but he may have discretely tweeted about the incident around the time the it began.

In any case, the surfer's actions have concerned wildlife officials. "You have to maintain your distance and we have guidelines, stated guidelines, that suggest don't feed the animals, don't pet the animals don't ride the animals," Pat Opay, National Oceanic Atmospheric Administration's Endangered Species Branch chief told KHON. "In this particular instance this individual was actually riding the animal."

Currently the NOAA enforcement group responsible for levying the appropriate penalties is investigating the incident.

Why all the hoopla when humans routinely ride dolphins & killer whales, not to mention horses, bulls, ostriches, camels, etc. etc. Some people seem to have no perspective; this was only an isolated incident, albeit perhaps unwise. As far as turtles being "intelligent", give me a break--perhaps in the animal sense, but that's all.

Of course intelligent in the animal sense. Duh.

Some creatures are designed to ride; most are not. If you grab a flipper and pull it the wrong way or put too much weight on it, you could doom the turtle to drowning or starvation.

The "hoopla" is because the fellow who did this claims to be a supporter of sea turtles, yet he endangered one.

To everyone who thinks this is okay, riding sea turtles, please take note that this wasn't even a large one. The turtle he is shown riding is still quite young and could have been harmed easily.

Turtles can't say "Ouch." Hands off.

The man in the video clearly threatens bodily harm to Jamie O'Brien. Why are the police not Hunting down the Cyber Bully that is heard in the video threatening to do harm to Mr O'Brien if he catches him in his surf spot. Someone should notify the Authorities in Hawaii before this dangerous Vigilante has the chance to Attack Mr. O'Brien as he clearly threatened to do in the video.

He should have to pay the fine for harassment , but Sea Turtles have made a come back the are protected not endangered, there is a difference.

"Protected" status applies to all animals designated as special concern or higher. The loggerhead is listed as threatened, but this is not a loggerhead. All other sea turtles are listed as at least endangered.

I'm not sure what happened to my previous post. Others posted since then have already appeared, so here we go again:
"Protected" is not a conservation status. It applies to all species on the endangered or threatened list. Loggerheads turtles are listed as "threatened" on the US Endangered Species list and Endangered on the IUCN list. All others are listed as at least endangered on both.

It is against the law to touch (Marine Mammal Protection Act and Endangered Species Act) harass or even chase turtles, dolphins, etc...although it may not have harmed the turtle, it was against the law regardless. The law is there to protect the animals and not make them become used to humans as they can become injured by getting used to human interaction - whether they end up getting hit by a boat or otherwise....I am sure NOAA will be in touch with him soon. Even if the animal is injured and on land, you must contact the proper authorities and not touch the animal...you can be fined!

I have a state wildlife permit that covers reptiles. Though there are specific restrictions, my permit does allow providing assistance to many threatened or endangered turtles BUT NOT SEA TURTLES. Even licensed wildlife rehabilitators must defer to special federally licensed authorities for these animals.

If he was harassing the turtle, where is the plaintiff? Has the turtle filed a complaint that s/he was being harassed? Saying the turtle is being "harassed" is mere conjecture and speculation on the part of those who were not privy to the interaction between the interested parties. There is no evidence that the turtle felt threatened or harassed.

That isn't the point. Even if the turtle couldn't "voice" it's opinion, it still might have felt threatened or harassed. Just because you didn't hear a complaint doesn't mean that nothing wrong was done.

First of all I want to state that Jamie was way out of line in even touching that turtle. But to make matters worse, the video comments by whoever that was, was even more out of line. I was born and raised here and I'm sick and tired of "local" and their use of the word Haole. Not only did this guy use a racial term, he also threatened Jamie. Get a clue and if you want respect you have to give respect.

But you don't KNOW if he was hurting it, that's the point. Ponies can convey pain quite clearly. Sea Turtles move much more slowly and are extremely gentle - they can't tell you it hurts, except by trying to swim away.
