George Zimmerman: Stand Your Ground Laws Unknown To Him When He Shot Trayvon Martin

In an interview Wednesday night with Fox News talk show host Sean Hannity, George Zimmerman said that when he shot and killed Trayvon Martin back in February, he was unaware of Florida's Stand Your Ground law -- the same law that apparently shielded him from arrest for several weeks after the killing.

In the exclusive one-hour interview with Hannity, Zimmerman said that he was unaware of the law, while his defense attorney, Mark O'Mara, for the first time said that he might assert the law as a defense at trial.

"Now that we have a lot of evidence considering what is self-defense, I think it's a proper presentation to go to a jury," O'Mara said.

It was O'Mara's first public affirmation of the defense. Previously he maintained that Zimmerman's actions on the night of February 26, when he shot and killed Martin in a gated community in Sanford, Fla., were more likely simple self-defense than a clear-cut case of Stand Your Ground.

"That statute has some troublesome portions to it, and we're now going to have some conversations and discussions about it as a state," O'Mara said during a press conference back in April. "But right now it is the law of Florida, and it is the law that is going to have an impact on this case."

Last night O'Mara said more affirmatively that Zimmerman acted in self-defense in accordance with the law.

Zimmerman was taken into custody the night of the shooting but was released a few hours later. According to early police reports, investigators, including lead investigator Chris Serrino, believed there was enough evidence to charge Zimmerman with negligent homicide. But at some point, then-Police Chief Bill Lee Jr. and State Attorney Norman Wolfinger opted not to arrest and charge Zimmerman in Martin's death.

Lee said publicly that Zimmerman had a right to defend himself under the law and that the legal bar to charge someone when they assert a self-defense claim was high.

The state's Stand Your Ground laws give wide discretion in the use of deadly force.

In a letter posted on the city of Sanford's website a few weeks after the killing, as the national spotlight grew hotter on Sanford and its police department for the handling of the case, Lee wrote that "by Florida statute, law enforcement was prohibited from making an arrest based on the facts and circumstances they had at the time."

"Additionally, when any police officer makes an arrest for any reason, the officer must swear and affirm that he/she is making the arrest in good faith and with probable cause," Lee wrote. "If the arrest is done maliciously and in bad faith, the officer and the city may be held liable."

Lee later stepped down as chief and was eventually fired by the city. Wolfinger, the state attorney, recused himself from the case, citing an unspecified conflict of interest.

Soon thereafter, Gov. Rick Scott convened a special task force to review the law and make recommendations on what changes, if any, might be appropriate. Scott also appointed special prosecutor Angela Corey to the case. Corey, who eventually brought second-degree murder charges against Zimmerman, has had her own complicated history with the Stand Your Ground law.

Corey prosecuted the case of Marissa Alexander, a mother of three in Jacksonville who was sentenced in May to 20 years in prison for firing what her family described as a "warning shot" at her abusive husband.

In that case, a judge struck down Alexander's Stand Your Ground defense, and a jury found her guilty of three counts of aggravated assault with a deadly weapon.

While the Alexander case did not garner the kind of national attention the Martin case has received, it did draw more attention to a law that some say has been misapplied, and with racial bias.

"Justice, with the laws of the state of Florida, was served," Corey said at the time. "But I don't believe her supporters will ever believe that."

Meanwhile, Scott's task force, which has been criticized as toothless and flawed, has traversed the state, holding public forums and speaking with local legal experts and attorneys.

The19-member task force, led by Lt. Gov. Jennifer Carroll, has been faulted as inherently biased and unfairly weighted with supporters of Scott, a Republican, and of the law itself. Four of the lawmakers on the panel either authored or voted for the law.

"This law is not the law that many of our legislators voted for. Nobody meant for this law to protect someone like George Zimmerman," task force member Rev. R.B. Holmes told The Huffington Post in June. "I think the Stand Your Ground law goes too far if criminals and thugs and drug dealers and gangsters and race haters -- black or white -- are using this law to protect themselves. But if a law-abiding citizen uses this law to protect his or her family, I think that is a good thing."

Opponents of the law say the problem is the law's vague and ambiguous language. Among them are Trayvon Martin's parents, who testified at one of the panel hearings held just outside of Sanford.

"Where does it say in these laws that the neighborhood watch volunteer can chase down an unarmed teen, shoot him and claim self-defense? We're not against the law. But the law has to be re-evaluated," Tracy Martin, the teen's father, told the panel. "Basically this law is telling us that it's okay to be a vigilante in our society," he said. "Fix these laws so that the law applies to a person who is literally in danger and trying to protect himself or herself."

Also of concern to some critics is the law's origin with a right-wing conservative lobbying and policy group, the American Legislative Exchange Council. ALEC has crafted such laws for states across the country and threw its support behind Florida's law. Due in part to scrutiny over the group's involvement in Stand Your Ground, as well as its role in controversial voter ID laws, civil rights groups and activists have rallied to put greater pressure on ALEC and its corporate sponsors. Several, including Pepsi, Coca-Cola, Amazon, Walmart and Dell, have severed ties with the group, which has since stated it would eliminate its social policy operation.

In the days and weeks after Zimmerman, 28, shot the unarmed Martin, 17, thousands across the nation took to the streets in protest. Petitions for his arrest and the repeal of the Stand Your Ground laws were drawn up and circulated on the web. Zimmerman became an unwitting symbol of the law and the underlying racial biases that its opponents see in its application.

But in Wednesday night's interview with Hannity, Zimmerman maintained his innocence of any crime and an ignorance of the law from which he has, at least initially, benefited.

Hannity said: "A lot of this case legally -- and we are going to get to Mark [O'Mara] in a few minutes here and ask him about a lot of legal aspects, because there are so many of them in this case -- has to do with Stand Your Ground. You have heard a lot about it. And I was just curious, prior to this night, this incident, had you even heard of Stand Your Ground?"

"No, sir," Zimmerman responded.

"You have never heard about it before?" Hannity asked, to which Zimmerman responded simply, "No."

Zimmerman also stated in the interview that he was neither a racist or a murderer. He said that he had no regrets: not for getting out of his car to follow Martin that night, not for having a gun on him or for firing the single, fatal shot into Martin's chest.

"I feel that it was all God's plan and not for me to second-guess it or judge it," Zimmerman said.

Martin's family has since condemned Zimmerman's comments.

"We must worship a different God, because there is no way that my God would have wanted George Zimmerman to kill my teenage son," Tracy Martin said in a statement.

The Medical Examiners report recorded on 2/26/12 clearly states that at some point Zimmerman told and investigator that “He spotted a Black male walking between houses in the complex, should not have been in the neighborhood as he was performing his neighborhood watch." It goes on to say that he confronted the male and a fight broke out.
I clearly remember this being said briefly on the news and soon after George began to say that he was on his way to the store after calling his sister to report this. I guess since no one in the media caught on to question the change in story, he dropped the part about calling his sister.
The ME report was recorded at 2/26/12 It further says that witnesses observed the 2 males fighting and the gun went off and the male fell to the ground.

By Zimmerman's own account he volunteered to follow this child against the direction of the 911 operator. If he was not going to follow their directions why call and give a detailed account of everything that is going on? He was negligent in not following the direction of the 911 operator he called when he wanted police to back him up. If Trayvon had not been scared and ran off, Zimmerman would have had police to back him up. In Zimmerman's mind Trayvon brought this on himslef by running and confronting him away from the area where he told police he would be. Zimmerman has "little man complex" and needs to make himself feel and look bigger than everyone around him but Trayvon took that away from him. Zimmerman could not let Trayvon live to tell the story. The stand your ground statute has nothing to due with this situation, but Florida judges have a record of ruling in favor of the survivor and not the dead. Zimmerman not only knew this, but he also knew if had not KILLED Trayvon he was going to do time because the stand your ground does not work if the person who you claim is threatening your life lives. In Zimmerman's mind this 6'3 child has to die if he wants to spend the rest of his life on the outside of prison walls. Zimmerman is guilty of killing this child and he should be punished for it.

Zimmerman could not compete with the size and strength of this child and shot him out of fear that people would know he got beat up by a child. This is a media circus because the police did not do their job completely by testing Zimmerman. The lead detective recommend Zimmerman be arrested. Zimmerman's story keeps changing because people keep asking finding flaws in his story and questioning him on it. Zimmerman has the time to come up with new versions of what happened that night because there are no witnesses to the incident. Zimmerman is not guilty of murder 1 because he did not plan this crime before that night. I do not think he is guilty of murder 2, but I do believe he is guilty of voluntary negligent homicide.

Zimmerman is 5'9 and Trayvon was 6'3. What man under 6 feet is going to willingly follow or walk up on a man who is 6'3 unless he has a gun giving him "steel curious"? Let's just say Zimmerman's version of this story is true, " he was following Trayvon and lost sight of him and Trayvon jumped out at him and asked him why was Zimmerman following him". It is poosible, but all this says is that Trayvon felt threatened and did not think he was going to make it back to the house before the man chasing him caught him. Trayvon is in fear his life is in danger. He did not know why someone was chasing him. He hid to catch his breath, and devised a plan he thought would get him home safe. He jumped out at Zimmerman and questioned him. Zimmerman saw a scared child and thought he was going to take advantage of the situation. Zimmerman had steel curious so he figured he was man enough to handle this child who proved to be stronger than Zimmerman anticipated. When Trayvon realized his life may be in danger he hit Zimmerman a few times hoping he would fall and he could run the rest of the way home. On Zimmerman's way down he grabbed Trayvon and pulled him down with him.

Zimmerman was guilty when got out his car and followed Trayvon. He knew what he was going from the word go.. Now he wants the world to believe that Trayvon attacked him. There is no way anyone is going to confront someone that they don't know unless they have a weapon to protect themselves. Never knew that ice tea and a bag of candy was a weapon... And Zimmerman's reasoning for killing a 17 year boy, is weaker then two straws holding up a bridge. Zimmerman has no remorse and he needs to keep his fake apology to his self..

You have to be as sick a Zimmerman to believe is lying story that he has changed so many times... For some one who claims that he was in such torment over the killing he sure has no remorse over killing a 17 year old boy that did nothing. He don't make any sense, when he said " I wasn't following him I was walking in the same direction so I would know his" Trayvon's location". Is that not following a person!!?? And just like the officer said, he Zimmerman would of stayed in his car, none of this would be. He's been playing wanna be cop, for a long time and he did know about the "stand your ground" law. this is why hes' trying to use it... He's a liar.............

Here's my confession: I am writing a comment without reading the entire article. Why? Because I just want to point out that George Zimmerman is a "cop wannabe." This means that he did not release his desire to have "police authority" after he failed to become an officer. It was his grandiose image of himself as "the enforcer" which fueled his night of terror (for an innocent teenager) and resulted in 2nd degree murder. I'm not gloating about this comment; I am weeping because a child died needlessly.

How can this muderer claim self defense when along he was the aggressor from the onset, he intentionally followed this kid without identifying himself. It was the gun that gave him the nerve to get out his car and confront this kid and he had the nerve to say it was god's will for him to kill this kid in essence with that weak b.s. apology. Apologies comes from the heart when the deed is done from the start not the end when trying to make point to the public of him trying to act contrite and human for the needless killing of this young kid by taking the law in his hands because he had that gun and his so called account because this teen can't defend himself now or ever, all because this killer thought this black teen was a thug robber and didn't have the right to walk peacefully to his father's house in a gated community!

I have never seen a street fight where suddenly someone begins to smother the other, choke maybe, but smother never. If this were true, why doesn't the autopsy not report any blood on Trayvon's hand or under his nails. Surely if you are punched so hard in the nose that it breaks and knocks you to the ground - surely there is blood and a lot of it as he described, yet there is no report of blood on Trayvon's hands

How was it self defence? It was even equal force if the teenager did attack him. You're about as dumb as they come. If you have kids I feel sorry for them. If they do something wrong and get punished for it dont be mad just know that its apparently gods will according to Zimmerman
